ENDLESS FANTASY (NOW ON iTUNES)

This gets better every time I listen to it. It transcends its generics and becomes something that I hope everyone can find some joy in. For me, I find it in the “fuck shit up” line in “Japan Air” and that amazing rant at the end of the record.

The first-sale doctrine has been a fundamental of copyright law since the age of Charles Dickens. Here’s how it works.

I make a book. You buy a book. You now possess and own that book. I own the intellectual property that manifested the book. You are free to loan and resell that book to whomever you want. I am free to print more books and sell them to more people until such a point as my exclusivity over the idea of the book expires. Then the book belongs to the public.

This is done to promote the growth of culture. It was a gateway for introducing new creators to commerce, and it worked pretty well until Walt Disney and Sonny Bono walked through that gateway and slammed the door from the other side.

The Xbox One’s digital-rights management mechanism is not about piracy. Piracy is a reaction to an unfair market (Fair and open markets always have lower piracy rates. Deprivation, gouging, and inconvenience create piracy.). This is a content-creator demanding both control and revenue over how content is consumed. It’s a spear pointed at the hearts of GameStop (who sucks) and Amazon (who might suck, depending on the weather I guess).

Some of these questions have obvious answers. Some don’t.

Do you own the books on your bookshelf? Do you have the write to sell that book? Do you have the write to sell its characters? If no, will you have that right in 20 years?

Do we think of Microsoft a content creator or a facilitator of content? If they own the platform, do they have absolute control over how that platform is used? When they take the platform away, do you maintain any possession or “license” of the content you purchased through it?

And finally, how will you be compensated when your right of first-sale is diminished?
